Woman arrested in Spokane, Wash. accused of threatening to kill federal judge in Victoria

CORPUS CHRISTI, Texas – On November 9, 2021, a federal arrest warrant was issued charging Elena Markham of Spokane, Wash. with threatening a federal judge in Victoria with murder.

The criminal complaint said around April 30, 2021, the Texas Department of Family and Protective services received a call from a local hospital regarding Markham who had given birth to a child the day before. Hospital staff was concerned Markham was acting strange and stating strange things. The hospital staff reported Markham claimed she was trafficked as a child and had some of her internal organs stolen. She also claimed Child Protective Services was involved in stealing babies. After a full investigation CPS removed the newborn from Markham due to safety concerns. The investigation revealed Markham had multiple children removed from her in Spokane. Investigators believe Markham traveled to Victoria to avoid having another child removed by state authorities in Spokane. The affidavit said Markham left a voice message threatening to shoot and kill an employee from Child Protective Services.

In late May Markham filed a civil lawsuit in federal court in the Southern District of Texas against several agencies. It demanded return of the newborn and $3.8 million in damages. On June 10, 2021 a judge  recommended the lawsuit be dismissed with prejudice as frivolous with no specific facts or logical coherent allegations. The lawsuit was dismissed on October 11, 2021.

Early this month the complaint said a woman calling herself “Elena” left two voicemail messages for Judge John Rainey upset her lawsuit was dismissed. The first call was for about three minutes and 46 seconds. The second voice message was about four minutes and 20 seconds. The caller mentioned the newborn by name. In the voice messages, Markham claims judges are afraid to deal with human sex trafficking. The warrant said Markham said, “what about a bullet in your head, maybe that’ll work”. The complaint said Markham said Judge Rainey is in her “war book” and that if she sees Judge Rainey in a tunnel, he will be shot by her “team”.

Markham is in custody in Spokane.
