VERDICT IN: Trevino found not guilty on three charges

VICTORIA, Texas- Update 3/6/2020 10:45 AM

A verdict was reached just after 8 p.m. Thursday. Trevino was found not guilty on three of the nine counts he was tried for in for the past two weeks. Two of the 11 counts were dropped prior to the trial beginning.

The charges Trevino is now acquitted of, are as follows:

  1. Indecency with a child by exposure
  2. Indecency with a child by exposure
  3. Injury to a child with intent of bodily harm

According to Brent Dornburg, one of Trevino’s lawyers who spoke briefly to Newscenter 25 after the verdict, stated the jury was “hung up or split” on the six other counts.

These counts are now up for mistrial. Dornburg believes the prosecution, led by special prosecutor Timothy Poynter, will retry Trevino.

The charges are as follows:

  1. Aggravated sexual assault to a child
  2. Indecency with a child by sexual contact
  3. Indecency with a  child by sexual contact
  4. Indecency with a child by sexual contact
  5. Indecency with a  child by sexual contact
  6. Indecency with a child by sexual contact

Trevino is currently out on bond.

Update 3/5/2020 6PM

Both the prosecution and defense presented closing arguments to conclude a nearly two week trial. 

Numerous witnesses have taken the stand to recount alleged crimes dating as far back as 2003.

Treviño was indicted in April of 2018. 11 charges follow his name, including sexual indecency with a child, injury to a child and injury with bodily harm. 

Special prosecutor Timothy Poynter detailed inappropriate touching and sexual abuse.

The victims are now adults, they took the stand to face the suspect.

One of the defense attorneys, Brent Dornburg, stated his team believed witnesses lacked credibility, pointing at inconsistencies in testimonies and saying this was fabricated after a divorce where a child custody battle was once a factor. 

As of Thursday, the jury rested around noon, going into deliberation. There is no time limit in which the jury must come to a verdict.

Newscenter 25 spoke briefly to a family member of a victim.  She said was ready for this painful experience to be over. 

Trevino may face up to life in prison pending a verdict. This is a developing story, check back for updates. 

 

Original story 3/5/2020 11AM: Closing statements will be presented Thursday in the trial against 46-year-old, Ruben Trevino, who is accused of assaulting minors in his family. charged with Aggravated Sexual Assault of a Child, among other charges.

Trevino has an eleven- charge indictment including:

-Five charges of Indecency with a Child Sexual Contact

-Three charges of  Injury Child/Elderly/Disabled with Intent to Cause Bodily Injury

-Two charge of Indecency with a Child through Exposure

-One charge of Aggravated Sexual Assault of a Child

Opening arguments were on Wednesday February 26th. Trevino has pleased not guilty to all eleven charges.
