Update: John Davila sentenced to life without parole

Posted: Updated:

Updated: A jury found John Davila guilty. He was sentenced to life in prison without the possibility of parole.

Today was the fourth day of the Davila murder trial where we are able to witness John Paul Davila taking the stand. In Davila's statement, he claimed that he beat up the victim, Victor Herrera, for 10 minutes, took a break then continued to beat him up for 10 more minutes on his knees.

The prosecutor assigned to Davila's case said that he had a difficult time believing Davila could continuously punch someone for that long and asked if Davila could do it again. Davila then stood up and stepped down from the stand where he began punching the floor repeatedly while the prosecutor began timing him and the courtroom fell silent. After 2 minutes and 15 seconds, Davila's attorney objected for relevancy.

Davila claimed that he only beat Herrera and left him unconscious, and did not kill him. Herrera's injuries were extensive, showing there was some sort of weapon involved, which is not consistent with Davila's alibi.
