Update: Child dies, mother charged after US 59 accident

The Texas Department of Public Safety has confirmed the 10 year old child ejected from a car after a US Highway 59 accident has died. The child was taken off life support this week before passing away. Her mother, Marlene Lisa Guzman, has been charged with Intoxication Manslaughter after the death of her daughter. Her husband and two other daughters are okay and were discharged from the hospital shortly after the May 25th accident. Since the rest of her family is okay, Guzman will not face three charges of Intoxication Assault.

A child is in critical condition after a one car accident happened off US Highway 59 and Midway early Friday morning. 

According to the Texas Department of Public Safety, the driver, Marlene Lisa Guzman of Victoria, along with her husband and three children, were driving when she swerved to the right, colliding head on with a guard rail. Her ten year old child was ejected from the car. After a good Samaritan attempted to give the family a ride to Detar Navarro, Guzman became belligerent and aggressive towards him, prompting him to call the police. Guzman was arrested after officers determined she had been driving under the influence.

Her husband, along with their 8 and 9 year old children were transported to Detar Navarro with non-life threatening injuries. The ten year old was transported to University Hospital in San Antonio. She is in critical condition. Guzman has been charged with four counts of intoxication assault for her role in the accident.
